lol. People would kill their granny for a Green Card. It's the last step before citizenship which only differs by passport and the right to vote. That is why so many people with Green Cards don't bother becoming citizens as they have no desire to vote. But with so much immigration turmoil around the world, many feel compelled to get citizenship.

Interesting opinion from an attorney on this custody battle, citing a California statute that may aid in the ruling in Vika's favor:

From the article, the California statute, Family Code section 3405:

"(a) A court of this state shall treat a foreign country as if it were a state of the United States for the purpose of applying this chapter and Chapter 2 (commencing with Section 3421).

(b) Except as otherwise provided in subdivision (c), a child custody determination made in a foreign country under factual circumstances in substantial conformity with the jurisdictional standards of this part must be recognized and enforced under Chapter 3 (commencing with Section 3441).

(c) A court of this state need not apply this part if the child custody law of a foreign country violates fundamental principles of human rights."


Comment:

I've read that Vika has already gone to the Family Court in Belarus and was awarded custody via such. If this is the case, then the California court has to honor the Belarus' ruling on the custody matter and award custody to Vika.

Yet, I'll need to find out if this is the case and read whether the custody matter was determined for sole or joint custody.

Yet, subsections 3427 and 3428 pertain to jurisdictional matters between courts and requires substantial documentation and facts from the 2 parties in order for the one court to defer to the other court. Given those stipulations, imo, Vika has a clear edge, for this guy is "unemployed" and doesn't have a permanent residence, for he was a golf instructor in "Hawaii", not California and made 4 trips to Belarus, while staying with Vika in "her home" in Manhattan Beach. Now, in this custody issue how can he be given custody with no job, no permanent residence and no means of providing support for Leo, save for a judicial ruling in his favor for "sole custody", for even in a joint venture, he doesn't have assets?

Yet, remember the late, great actor Lee Marvin who had a "palimony" lawsuit filed against him by his live-in partner? He lost big via a court ruling. This guy here is trying to benefit from liberal laws favoring partnerships in the state of California, given that Vika is a multi-millionaire tennis player, while this guy is essentially a "vagabond".

His circs haven't changed since she willingly hopped into the sack with him unprotected. I do think too that the CA courts won't defer to a country with a poor human rights record as Belarus appears to have. For instance, they wouldn't want a child born in the USA or his parent to be potentially subjected to the death penalty. Vika could potentially face the death penalty.
